Effective July 1, 2004, persons who file a tort claim with a city pursuant to K.S.A. 12-105b will now have "no less than 90 days" to commence an action after the tort claim is denied by the city. House Bill 2553 attempts to create a bright line rule for claimants and effectively nullifies a number of appellate decisions interpreting the previous statute of limitations savings provision in K.S.A. 12-105b.
